Terms of Service
These Terms of Service ("Terms") govern your use of the Estetika Professional mobile application and website (the "Service") operated by Estetika Professional ("we", "us", "our"), a company registered in Belgium.
1. Acceptance of Terms
By creating an account, downloading the application, or using any part of the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service. These Terms constitute a legally binding agreement between you and Estetika Professional.
2. Service Description
Estetika Professional provides a mobile application and related services for beauty professionals including, but not limited to:
- Client profile management and contact organization
- Appointment scheduling and calendar management
- Digital consent form creation, customization, and signature collection
- Medical history tracking and health questionnaires
- Treatment portfolio and before-and-after photo management
- Multi-language support for international practices
The Service is currently in pre-launch beta. Features may change, be added, or be modified during the beta period. We will communicate significant changes to beta users in advance.
3. Account Registration
You must be at least 18 years old and a professional beauty practitioner (or authorized representative of a beauty business) to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate, current, and complete information during registration.
4. Subscriptions & Pricing
We offer the following plan types:
- Founders Club (Lifetime): A one-time payment for permanent access. Limited to 200 total spots.
- Early Bird Annual: Annual subscription at a discounted rate available during the pre-launch period.
- Standard Plans: Monthly and annual subscription plans available after public launch at regular pricing.
All prices are displayed in Euros (EUR) and include VAT where applicable under Belgian and EU VAT regulations.
5. Founders Club Terms
- Founders Club membership provides lifetime access to the features included in the purchased tier (Solo, Studio, or Clinic) at the time of purchase, plus all future updates.
- Lifetime access means the duration of the Service's operation. If Estetika Professional ceases operations, we will provide at least 6 months notice and a full data export.
- Founders Club memberships are limited to 200 spots total. Once all spots are claimed, this offer will no longer be available.
- Founders Club memberships are non-transferable between accounts without prior written consent. [LEGAL REVIEW NEEDED: Confirm transferability terms.]
6. Payments & Billing
All payments are processed securely through Stripe. We do not store your full payment card details on our servers. For annual subscriptions, billing occurs at the start of each billing cycle. We will notify you at least 14 days before any price increase on your current plan.
7. Refunds & Cancellations
7.1 EU Right of Withdrawal
Under EU Consumer Rights Directive 2011/83/EU, you have a 14-day right of withdrawal from the date of purchase. To exercise this right, contact us at support@estetikaprofessional.com with your order details. Refunds will be processed to the original payment method within 14 days of receiving your withdrawal request.
7.2 Annual Subscriptions
You may cancel your annual subscription at any time. You will retain access to the Service until the end of your current billing period. No partial refunds are provided for the remaining subscription period after the 14-day withdrawal window.
7.3 Founders Club
Founders Club lifetime purchases are eligible for a full refund within 14 days of purchase (EU right of withdrawal). After 14 days, Founders Club purchases are non-refundable.
8. Acceptable Use
You agree not to:
- Use the Service for any purpose other than legitimate beauty/aesthetic practice management
- Store data that violates applicable laws or third-party rights
- Attempt to circumvent security measures or access other users' data
- Reverse engineer, decompile, or disassemble the application
- Use automated systems to access the Service (scraping, bots)
- Share your account credentials with unauthorized parties
9. Data Responsibility
As a practitioner, you are responsible for the accuracy and lawfulness of client data you enter into the Service. You must obtain appropriate consent from your clients before entering their personal data, including medical history and photographs. You act as a data controller for your client data, and Estetika Professional acts as a data processor on your behalf. Our responsibilities are detailed in our Privacy Policy and the Data Processing Agreement available upon request.

10. Intellectual Property
The Estetika Professional application, website, brand, design, and all related intellectual property are owned by Estetika Professional. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service. You retain ownership of all content you upload (photos, text, forms).
11. Limitation of Liability
To the maximum extent permitted by Belgian and EU law, Estetika Professional shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim. This limitation does not apply to liability that cannot be excluded or limited under applicable law (e.g., fraud, gross negligence).
The Service is not a substitute for professional medical or legal advice. Consent forms generated by the Service are tools to support your practice but their legal validity may vary by jurisdiction. [LEGAL REVIEW NEEDED: Confirm consent form enforceability guidance for Belgium and EU.]
12. Termination
You may terminate your account at any time through the app settings or by contacting us. We may terminate or suspend your account for violation of these Terms, with prior notice except in cases of severe violation (fraud, illegal activity). Upon termination, you may export your data within 30 days before it is permanently deleted.
13. Governing Law & Disputes
These Terms are governed by the laws of Belgium, without regard to conflict of law provisions. Any disputes shall be submitted to the competent courts of Belgium. For EU consumers, nothing in these Terms affects your statutory rights under EU consumer protection law, including your right to bring claims in the courts of your country of residence. 14. Changes to These Terms
We reserve the right to modify these Terms. Material changes will be communicated via email or in-app notification at least 30 days in advance. Continued use of the Service after changes take effect constitutes acceptance. If you do not agree with the updated Terms, you may terminate your account.
